Recently, a U.S. federal court issued a ruling finding the Trump administration's $100,000 H-1B visa fee unlawful.
The H-1B visa allows U.S. companies to bring in skilled foreign workers to work in the United States.
The court said the fee is essentially a tax, which the president cannot impose on his own. The core reason for the ruling: under U.S. law, the power to tax belongs only to Congress.
The government argued that immigration law grants the president this power, but the court disagreed, finding that current law gives the president no such authority. The court also found flaws in the government's decision-making process.
The case was brought jointly by twenty states. Previously, companies paid only a few thousand dollars for such visas; after the fee surged to $100,000, many companies, students, and workers grew worried and went to court together.
For the government, this is clearly a major setback, but the matter is not yet settled. The government may appeal, and with similar cases pending in other cities, the outcome remains uncertain.
